內銀加存息 迎戰網上金融

投訴公開私隱 去年增逾八成
self storage【記者賴秋妤報道】隨�智能手機日漸普及,本港幾乎人人成為「低頭族」。個人資料私隱專員公署去年收到93宗涉及資訊科技應用的投訴,按年大增86%。另外,公署在去年抽查了60款本地開發的智能電話應用程式,結果發現只有六成程式有向用家提供私隱政策聲明,促請開發公司應向用戶詳細交代,並呼籲市民安裝程式時提高警惕。環顧四周,不難看見大部分人都拿�手機,瀏覽Facebook或WhatsApp等智能電話應用程式。公署去年收到93宗涉及資訊科技應用的投訴,較2012年的50宗大增86%。當中有40宗是投訴個人資料被放上社交網站,12宗投訴在WhatsApp接收到促銷訊息。個人資料私隱專員蔣任宏昨日在記者迷利倉上指出,透過WhatsApp賣廣告的機構,多是隨機抽出手機號碼,按現有條件無法跟進。他又稱,擅自將他人資料放上網的個案,大部分都不能追查發布人的身份,但受害人可要求網站管理者刪除資料。蔣任宏建議用家透過網站設定,限制他人瀏覽個人資料。公署已邀請社交網站Facebook的職員5月來港,講解用戶私隱設定。下載應用程式要留意針對資訊及通訊科技應用方面,公署於去年抽查了60款本地開發的智能電話應用程式,結果發現只有六成程式有向用家提供私隱政策聲明,大部分沒有解釋程式會讀取手機上哪些資料和讀取資料的目的。蔣任宏呼籲,市民下載手機應用程式前,要留意程式私隱聲明及蒐集個人資料的用途,再決定是否安裝程式。迷你倉

Carroll commissioners to discuss ruling on release of email lists
Source: The Baltimore SunJan.儲存 23--Carroll County commissioners have lost their case against several media organizations and now must decide whether to comply with a judge's order to turn over email lists or appeal.The five commissioners plan to meet in closed session Thursday to discuss the case, which resulted in a court order last week giving the board until early February to provide email distribution lists used by the commissioners, including the email addresses. If they choose to challenge the ruling before the Maryland Court of Special Appeals, they would have until mid-February to do so.In an opinion issued Jan. 16, retired Howard County Circuit Judge Dennis M. Sweeney ruled against the commissioners, who in March denied a Carroll County Times reporter's request under the Maryland Public Information Act for mailing lists, including email addresses, that the commissioners use to contact groups of people.The Times' reporter's case was later joined by The Baltimore Sun, the Washington Post and WMAR-TV.The commissioners argued that releasing email addresses would "cause substantial injury to the public interest," because it could compromise citizens' privacy and possibly discourage people from contacting the board.Sweeney ruled these public-interest concerns "are not trivial" and perhaps the state legislature should review the policy. But he ruled that they did not meet the standard of evidence of potential "injury" to public interest.Charles Tobin, a Washington-based lawyer who represented the media companies, said the lists were compiled by commissioners to contact groups of people. The email addresses are significant in understanding the way the county does business and were worth fighting to get, he said."The case will help prevent officials from building secret societies of supporters by using government email to communicate exclusively迷你倉with them," Tobin said. "An important part of open government is knowing who whispers in the ears of our elected officials."Commissioner Richard S. Rothschild, for instance, has a list called "Conservative Counties," and an email newsletter, "Inside the Boardroom," that he sent to one of the lists, Tobin said.County Attorney Timothy C. Burke declined to respond to requests for comment. Rothschild, vice president of the board of five Republicans, said in an email that media organizations operate under a partisan double standard.When Gov. Martin O'Malley refused a Carroll County man's request for an email list, claiming "substantial injury to the public interest," no issue was made of it, he said. But "the media was indignant when a Republican Board of Commissioners refused to release citizens' private email addresses for the exact same reason."According to papers filed in the Carroll commissioners case, James M. Graham III in 2011 withdrew his request to the governor after O'Malley's office responded by saying it would file suit seeking to protect the records, which is how the Carroll commissioners responded to the newspaper's request. In an affidavit filed with the case, Graham said he found the reference to possible litigation "intimidating."Tobin agreed the Graham-O'Malley instance is significant, but not for the reasons Rothschild gave."What O'Malley did points out why this case is important," Tobin said. "Citizens should not be forced to back down from their rights for fear of litigation."The county could be on the hook now for the media groups' court costs. Vision-impaired gain new skill in Harwich

For the crafty women in the Knit Lit program at Brooks Free Library, the burden is eased by a welcoming atmosphere, experienced mentors and chipper conversation."It's basically learning how to do things in a different way," says Carla Burke, who is blind and the assistive technology coordinator at Brooks Free Library. "It's a real adjustment. Lots of times people become isolated, depressed or bored."Burke lost her sight gradually from a degenerative retinal disorder. She began volunteering at the library and helping people with disabilities get access to materials and technology.In 2003, she implemented Cape Cod's first Vision Impaired Technology Assistance at the Library (VITAL) program and was hired within that year on a part-time basis to run it. Since then she has trained other area libraries on how to offer similar services."She's really become a resource for people on the Cape with disabilities," says library director Ginny Hewitt. Hewitt said Burke developed the training curriculum herself and credits her with starting the first municipal program of its kind in southeastern Massachusetts.In addition to taking on the task of improving library accessibility, Burke decided also to offer a "Learn to Knit" class in 2008. Six library patrons who were experiencing sight loss, ranging from limited functional vision to total blindness, were paired with seeing volunteers who taught them the basics of knitting as part of a six-week class. They were so enthused with knitting that they formed what is now the Knit Lit group to keep up the momentum.The weekly meeting is open to all knitters of any age or ability. Of the 24 active members, about six have a visual impairment. However, the group's mission is not angled specifically at assisting those with sight loss but rather including anyone interested in knitting.Despite its origins, Knit Lit today is less instructional and more social. Still, advice circulates naturally for both sighted participants and those with sight loss. Members will casually discuss books they happen to be reading or listening to, and they also org迷你倉出租nize regular charity projects. Some of the projects included donating a hodgepodge of winter apparel for the Latham Center, chemotherapy head caps for Cape Cod Hospital and a blanket for the Family Pantry of Cape Cod."It gives you a purpose," Burke says. "It's something you are accomplishing and it's relaxing."Susan Riley of Chatham was one of the original six who participated in the 2003 knitting class and is a fixture at Knit Lit. She is legally blind due to a degenerative retinal disorder and describes her sight as tunnel vision.Riley was referred to Brooks Free Library by the Massachusetts Commission for the Blind for computer classes. Upon meeting Burke, she was urged to join the knitting class."I had never knitted before," she says. "I didn't know if I'd be able to do it." But with the help of a mentor she knitted her first scarf. "One side was larger than the other," she says with a laugh.Many of the current Knit Lit participants speak of the lasting friendships and memories they have woven through the program."It was like a godsend for me because it opened up a wide range of people," Riley says. She says now she is able to arrange for rides to the library with other knitters.Mary Lopez of Harwich, who has been knitting since she was 11, was one of the volunteer mentors for "Learn to Knit," and said that the bonds began during the class. "There's a feeling of camaraderie," she says.Another Knit Lit member, Frances McLaughlin of Harwich, who was also one of the original six students, is legally blind from glaucoma and says that the tactile nature of the craft is helpful exercise to those with vision loss because it is an opportunity to figure things out with your hands.She also says that the greater benefit is the involvement in charity projects."To get out there and help somebody else," she says. "Not just focusing on your problem. You're helping other people and you help yourself in some way.""It's more than just knitting, it's social too," she says. "This is a real terrific group. 拚5G布局 郭台強促併購國外IP 大陸積極推動國際接軌

儲存 統籌:冼日明(中大市場學系教授)陳志輝(中大EMBA 課程主任)主持:冼日明、李靜宜嘉賓:尹慧兒(香港浸信會醫院企業傳訊及發展總監)嘉賓:梁立慧(香港應用科技研究院高級經理)整理:冼日明、謝冠東冼:冼日明李:李靜宜尹:尹慧兒梁:梁立慧李:今天的主題是品牌活化。說到品牌管理,對創業者來說是如何創立品牌。但對現有品牌,管理者須考慮強化品牌。品牌像人一樣,也會老和生病,因此管理者需要活化品牌。若真的走上了末路,無可救藥,管理者就要決定何時斷臂。產品演化周期理論冼:Motorola、海洋公園、柯達、亞洲電視、Esprit、甘泉航空、泰林電器──以上的品牌讓你們聯想起什麼?。梁:甘泉航空和泰林電器已經消失,雖然市面上仍有柯達產品,不過公司已經清盤。冼:Motorola、Esprit 及亞洲電視都已從高峰衰落。Motorola 近年被Google收購,亞洲電視的收視率及公信力低迷,Esprit近年則面對品牌老化的挑戰。李:海洋公園是衰落後重生的例子。公園在經歷沙士等不同衝擊後,入場人次屢創新低。不過,在經過一系列品牌活化行動後,現時海洋公園的形象充滿活力,2013年度入場人次更超越700萬。冼:雖然有重生的例子,但為什麼不少曾經在市場上叱吒風雲,深受消費者喜愛的品牌,始終無法延續其光芒,最終要面對衰退,甚至死亡的命運,為市場和消費者所離棄?尹:從前人們把品牌衰敗歸納為「產品生命周期理論(Theory of ProductLife-Cycle, PLC)」,指出品牌衰敗就像人無可避免的衰老過程。產品生命周期由新產品介入市場的「介入期」開始,隨後是「成長期」,直至產品被消費者接受,踏入「成熟期」,最後因為本身或市場的原因步入「衰退期」。冼:根據這個理論,一個品牌就像一個人須經歷生、老、病、死的必然階段,似是命中注定。但為什麼在同一產品類別中,有些品牌的銷售不斷衰退,最終死亡,卻又有一些品牌能夠重生?例如在這個科技發達的年代,兩個從前的菲林龍頭品牌柯達和富士就各有不同際遇──柯達要申請破產,富士卻截然不同。梁:面對時代變遷,富士的應變能力比柯達好,它的產品範疇比柯達廣,在發現相機市場衰落後,它以相機技術開拓了其他市場,例如以沖曬菲林技術和攝影相關的納米技術應用於醫療範疇,邁向一個龐大的新市場,令品牌得以繼續生存。冼:我們可以藉此反思,到底品牌衰退或死亡是否不能避免?很多研究指出,品牌老化雖然是預料之內,卻是可以補救的。現時有一套嶄新的理論── 「產品演化周期理論(Theory of Product EvolutionaryCycle, PEC)」,取代舊有的產品生命周期理論。它總結了品牌衰退的三大因素:第一、品牌基因或內在因素,第二、外部環境的變化,第三、競爭對手的行動。首先談談內在因素。品牌基因不良的話,那就一早注定品牌短壽。除此之外,內在因素通常與管理失誤有關。尹:例如Esprit,在上個世紀不論在香港或歐洲都可說是一個卓越品牌。但現在Esprit的經營卻每況愈下,衰落的主要原因是公司內部未能捕捉市場需求的轉變。冼:另一個引致品牌衰敗的內部因素是產品質素下滑,或價格上升但質量卻未能配合。這個因素在亞洲家族式企業特別顯著。當品牌創辦人步入晚年,企業卻缺乏繼承人,品牌便無可避免地老化。梁:在「產品演化周期理論」中,品牌衰退的第二大因素是外部環境的變化,例如「法例轉變」。最近流動電話頻譜拍賣,就影響了各品牌的部署。PCCW 成功收購CSL,可能是因為CSL留意到環境的轉變,會令品牌加速老化,感到有壓力。「科技轉變」也屬外部環境變化。剛才提及的柯達就是例子之一,面對由菲林過渡到數碼的技術轉型,它束手無策。冼:環境的轉變就像一道巨浪,品牌要懂得乘風破浪才可以生存。Samsung 就精於此道,它看到傳統手機會被智能手機代替,於是與Google 的Android 系統合作,並成為Android界別的一哥。尹:除了法例和科技轉變外, 「經濟環境的轉變」也對品牌帶來影響。銅鑼灣一些數十年的老牌食店最近相繼結業,便是受經濟環境影響。當租金和勞工成本上升,這些傳統或家庭式的零售店相對連鎖店而言,是較為缺乏適應能力。李:品牌衰退的第三大因素來自競爭對手的行動。舉例說,面對快速時裝(FastFashion)品牌如H&M、Zara 等崛起,Esprit未能適應對手每星期換款這種快速步伐,只是原地踏步,結果被顧客離棄。哪些品牌值得活化?尹:剛才我們提到為何有些品牌出現衰退。它們可嘗試進行品牌活化(Brand Revitalization)來逆轉品牌的衰敗趨勢。在決定品牌是否需要活化前,管理層先要回答數個問題。第一是品牌衰敗的主要原因為何。冼:不少品牌管理人不知道品牌有何問題,於是在治療品牌時用錯藥,不但救不了品牌,更衍生其他問題,亦延誤了救治。尹:發現問題其實很難,因為管理層是局內人,看法和外面的顧客未必一致。所以要進行品牌評核,分別從內部和外部收集相關數據與分析。第二個問題是品牌的資產能否藉活化策略得以提升。冼:不少品牌即使救了也是徒勞,另一些則有較高機會可起死回生。後者有兩個特徵,第一是品牌在消費者心中存在差異化,與別不同。不少品牌只以低價格和其他品牌競爭,要是出現衰退就反映了價格不夠對手相宜,要拯救它只能進一步降低價格,但那可能會虧本;即使它不打價格戰,改而嘗試重新打造獨特形象,但因消費者一向認為這個品牌平平無奇,很難改觀,那也是十分困難。第二個特徵是品牌相對其他競爭對手可收取較高價錢,即是溢價。李:為何消費者願意付較高價錢?是因為品牌形象較好,消費者也希望使用產品時令他人聯想到同樣的形象。例如Gucci,它能成功活化,正因品牌曾有獨特形象。梁:管理層要問的第三個問題,就是企業是否有資源執行品牌的活化工程。冼:此外也要看管理層有沒有能力和遠見。一些機構每下愈況,關鍵在於管理層能力不足。冼:假若決定了要活化品牌,那就得配合活化策略,它有幾項要點。重新定位建立新優勢梁:首先是為品牌創立一個嶄新的定位,給消費者一個煥然一新的形象。冼:品牌形象老化或變得模糊會令消費者離棄自己,像天星小輪以往是香港的主要交通工具,但地鐵的出現搶走了不少乘客。這個品牌今日又如何重新定位?尹:天星小輪成為了香港人的集體回憶,品牌為他們帶來不同聯想。它更成為遊客心目中的香港標記,他們到香港都要乘坐小輪欣賞夜景,那成為賣點。李:另外還有研發,就是提供新的功能和設計,甚至還可引進新產品和服務,取代已喪失價值的舊產品。海洋公園近年就不斷增設冰極天地、熱帶雨林和香港老大街等新景點,令遊人刮目相看,入場人次屢創新高,擺脫了昔日的過時形象。* 「管理新思維」節目由中文大學行政人員工商管理碩士課程(EMBA)與香港電台合辦,星期日下午2 時至4 時在FM 92.6 香港電台第一台播出。EMBA網址:.cuhk.edu.hk/emba/*節目預告:1 月26 日題目:減廢的力量;嘉賓:OhYes It's Free創辦人日青迷你倉

Experts say McDonnell case may come down to intent
Source: Richmond Times-Dispatch, Va.迷利倉Jan. 23--Some criminal defense lawyers believe the federal corruption indictment against former Gov. Bob McDonnell may largely hinge on what prosecutors can or cannot prove about his intent.Others also say there is a legal question about whether the government has gone too far in alleging fraud."The whole case will come down to intent. It is not a crime to accept a gift from somebody. It is not a crime to accept a gift from somebody who does business with the state," said Barry Pollack, a Washington lawyer."It's only a crime if you do it with an improper and corrupt intent. ... It all comes down to what was in Governor McDonnell's mind when he was accepting these gifts," he said.Andrew G. McBride, a former federal prosecutor in Virginia who is now a defense lawyer, said McDonnell's lawyers may decide, "We have a good legal issue here: Is this sale of the honest services of your office, or is this just good old politics 101?""It is not the classic purchase of the honest services of a governor," he said of some of the allegations against McDonnell.In corruption cases against officials, federal prosecutors sometimes allege honest services fraud, part of federal mail and wire fraud law.Mail and wire fraud is the hook that federal prosecutors use to gain jurisdiction if phone calls, emails, traditional mail and commercial shippers are involved in an alleged crime.Part of the law addresses schemes to defraud by depriving "another of the intangible right of honest services." In political/government corruption cases, the honest services involved are those the public expects of government officials.Pollack said the honest services provision has been interpreted broadly in the past, but the U.S. Supreme Court narrowed it in 2010 in the case of Enron CEO Jeffrey Skilling, when the justices ruled the government must show there was a bribe or a kickback.However, Pollack said the justices did not define what constitutes a bribe, and therefore it is not clear whether they meant to require a specific quid pro quo.Pollack said some courts have interpreted the Skilling ruling narrowly to mean that there must be a quid pro quo -- the bribe is given in return for an agreement that the public official perform a specific official act.He said other courts have held that it need only be shown that someone made a payment or gift with the expectation of some unspecified official consideration from a public official and that the official accepted the gift with the understanding he was going to use his office to do something in return."The key question the court is going to have to resolve in Governor McDonnell's case -- and ultimately the Supreme Court is going to have to resolve -- is does that 'something' have to be something specific, something identified," said Pollack.Do both parties have to understand that in return for a gift, an official is going to take a specific action, or is it sufficient that there is just a general understanding that something will be done at some point, he asked.He said it appears the government hopes to prove that McDonnell had an improper intent in accepting the gifts by showing a pattern of dishonesty and a pattern of trying to cover up the relationship with Jonnie R. Williams Sr., then CEO of Star Scientific, and the nature of the relationship."For the government, all of these counts are kind of mutually reinforcing in that they show that this wasn't a single event that can be explained away. It's part of a pattern of conduct that demonstrates that he knew that he was doing something wrong," he said.For example, two of the counts allege the governor didn't disclose a debt to Williams when applying for loans to financial institutions, straightforward allegations presumably involving paper trails.However, Pollack said, "I do not think Governor McDonnell is any more or less vulner迷你倉ble on the false statement counts than on any other counts."Prosecutors often offer juries different theories of ways a defendant committed a crime."It is a cafeteria plan. The government hopes that if the jury does not like Theory A for some reason, maybe they will buy Theory B," Pollack said.What the government has done, as good prosecutors do, Pollack said, is allege crimes that all tie together in a way that demonstrates a theme -- that McDonnell was dishonest about the gifts and loans because he knew he should not be accepting them."I think the government's going to anticipate, correctly, that Governor McDonnell's defense is going to be: 'I didn't intend to do anything wrong, I didn't intend to accept any gift I was not permitted to accept,' " Pollack said.Peter White, a former assistant U.S. attorney in Virginia and Washington and now a white-collar criminal defense lawyer, said a problem he sees in the indictment is that it does not allege a specific, official act in exchange for the gifts."That's unusual as these cases go and presents some challenges for the government. That's the main obstacle they face," he said.He added: "I don't know of another public corruption case that's been brought recently and successfully where there hasn't been an official act in exchange for what is alleged, and I think the defense will take the position that (prosecutors) will have that obligation here, too.""The government may take the position they don't, but from what I can tell that's an untested legal theory," said White.McBride said he believes McDonnell's best shot is a legal motion before the trial to convince a judge that as a matter of law his conduct did not constitute official acts and that he did not allow anyone to purchase his honest services."They have one pretty strong legal motion to say the government is overreaching here -- they've taken this statute and they've gone too far. I mean, look, the Supreme Court reversed Skilling," he said.But, said McBride, "If that's denied and he has to go to trial, I think he's in a lot of trouble."Two of the charges accuse McDonnell and his wife, Maureen, of conspiring to obtain, or obtaining, "property under color of official right." Those charges allege violations of the Hobbs Act, which is aimed at extortion, even if the extortion target consents to turning over the property.Charles E. "Chuck" James Jr., a former federal prosecutor who does white-collar defense work with Williams Mullen's Richmond office, said the Hobbs Act does not require a threat of force or violence when an official solicits or accepts a thing of value to which he is not entitled.Speaking generally and not about the McDonnell case, James said that if the government can prove something of value was solicited or accepted in exchange for an official act, either party may be convicted.According to the U.S. Justice Department, the "color of official right" provision does not require that a public official take steps to induce the extortion payment because it can be said that the "coercive element is provided by the public office itself."Former Virginia Del. Phillip A. Hamilton was convicted of extortion in 2011 under the "color of right" provision in a public corruption case in federal court in Richmond.Pollack said those two "extortion" counts strike him as "the biggest stretch for the government." He said that while the statute may technically apply, the McDonnells' alleged misconduct appears far afield from the conduct the statute is intended to bar."Also, the idea that Governor McDonnell 'extorted' anything seems at odds with the government's theory that the gifts were given willingly as part of a bribery scheme," he said.Copyright: ___ (c)2014 the Richmond Times-Dispatch (Richmond, Va.)
